eSbuxStore is a business in the online retail industry that market books, electronic devices and related materials. The eSbuxStore can be accessed at www.esbuxstore.co.za, hereafter referred to as, (the Site.) The Site enables all visitors (users or you)  to see and purchase  items including books, stationery, bags, electronics and accessories among other things, by selected local and international brands (the Product), online and have them delivered door-to-door or door-to-post office counter within South Africa. For all international deliveries, please contact us first before processing any order due to legal requirements involved like Customs, Taxes, Duties and Distribution rules.



All users, including those that buy from the Site (buyers) are bound by these terms and conditions (T&Cs). By browsing or using the Site in any way, you hereby acknowledge that you have read, accepted and agreed to be bound by these T&Cs. Should there be any clause in these T&Cs that you do not understand, the onus is on you to ask eSbuxStore to please explain the relevant clause to you before you accept the T&Cs. If you do not agree to these T&Cs, do not continue to use the Site, as your continued use of the Site will constitute acceptance of these T&Cs, unmodified by you.



The Site is owned and operated by Croscill Investments CC, registration number CK 1997/04 3898/23, a company incorporated in the Republic of South Africa (hereafter referred to as Croscill). More information about Croscill is available at the end of these T&Cs.



Please note that, stocks of all Products on offer are limited. eSbuxStore will make all reasonable attempts to ensure that offers are discontinued when stock is no longer available. However, should eSbuxStore be unable to fulfil any order at the advertised price because stock is sold out, eSbuxStore will inform you via email or telephone and you will be entitled to a reimbursement for the rand value you have paid for such product, as explained in more detail in the eSbuxStore’s Delivery Policy.  Please note that, the eSbuxStore’s Delivery Policy is incorporated by reference and therefore forms part of these T&Cs.



a)     The Site allows you to place electronic orders (order) for one or more products on offer, for so long as such Products are still available and have not been sold out.

b)     A purchasing contact between you and eSbuxStore (Sale) only comes into effect once you have electronically submitted a properly completed order for one or more Products in your shopping cart AND payment is either authorised or received by eSbuxStore into its account.

c)     The above is subject to the stock of the Product concerned being available.

d)     Products are placed on reservation for only five days pending payment.

e)     Placing an item in your cart without completing the order does not amount to a sale.

f)      A  Value Added Tax (VAT) invoice will be enclosed in your order.



a)     eSbuxStore at all times reserves the right to refuse to accept or process payment on any Order and/or to cancel any purchase partially or completely, on notice to you.

b)     eSbuxStore shall only be liable to reimburse you the rand value already paid by you in respect of the cancelled portion of the Order. (Please see eSbuxStore’s Delivery and Returns Policy in this regards)


7.    FRAUD

a)     eSbuxStore reserves the right, in the interest of preventing fraud, to refuse the processing of payment for any order and/or to cancel any purchase, partially or completely.

b)     eSbuxStore may request documentation to complete the necessary fraud checks and cancel any order where such necessary documentation is not provided in a timely manner.

c)     eSbuxStore does not process refunds for orders suspected of fraud.

d)     eSbuxStore does not provide order details relating to orders suspected of fraud, except to legally authorised parties.



The price of each Product is displayed on the product information page (product page) on the Site.


a)     The Regular Retail Price:

              i.        The Regular Retail Price (RRP) is the standard prices that eSbuxStore charges for the product. The RRP is determined by considering the suppliers price, market conditions and the prices being offered by other local retailers.

             ii.        When a product is not on sale, on special, or included in a discount promotion, the RRP is the price you will pay when purchasing the product (purchase price).

            iii.        Please not that RRP can charge during the course of time over which the product may be sold. The RRPs applicable at the time the product is introduced may differ from the RRP at this time of your purchase.


b)     Pricing Accuracy:

              i.        Every reasonable effort will be made to ensure that the RRP and, if applicable, any Discounted Price of all products on eSbuxstore are correct at the time of your purchase. If however, the product is offered at an erroneous price, eSbuxStore will not be obliged to supply the said product at the incorrect price.

             ii.        eSbuxStore will only be liable to reimburse payment already made by you in the case you elect to cancel the sale once you have been made aware of the correct price.

You can pay on eSbuxStore using your NSFAS sBux voucher or Electronic Funds Transfer (EFT).


a)     Paying by sBux:

A successful sBux payment will be confirmed by email and eSbuxStore will start processing your order.


b)     Paying by EFT:

For EFT Payments please note:

               i.        When selecting to pay by EFT, you have up to 3 days, post placing your order to make the payment.

              ii.         When making your payment, please be sure to use your order number as your reference. This will ensure that eSbuxStore can process your order as quickly as possible.

             iii.         eSbuxStore will start processing your order after your payment reflects in our account. Depending on the bank, it can take up to 3 days from the time you make the payment (which payment has to be done a maximum of 72 hours after placing the order) to when it appears in our bank account.

             iv.        The delivery lead time as specified on the site only starts once eSbuxStore has received the payment from your bank.

              v.        Payments with incorrect, incomplete or missing reference are not considered complete until we have allocated the correct reference for the order and received proof of payment.

a)     Anyone downloading or trying to download malware or damaging coding on this site, or who tries to gain unauthorised access to any page on this site, will be prosecuted.

b)     eSbuxStore will claim civil damages from such person if eSbuxStore suffers any damage or loss.

c)     Users are required to ensure they take security measures to protect their data on their devices. eSbuxStore is not liable for security breaches outside our control.



a)     Save for eSbuxStore being liable to you; under the Consumer Protection Act 68 of 2008 (“CPA”) in relation to any Products sold by it to you via the Site; and under sections 43(5) and 43(6) of the Electronic Communication and Transactions Act (“ECT”) in relation to eSbuxStore  payment systems not being sufficiently secure, neither eSbuxStore  nor any of its agents or representatives will be held liable for any loss or accountability of  any kind that arises from the use of (or inability to use) this site, its services or content.


b)     eSbuxStore provides no guarantee, implied or otherwise, that the content or technology attached to this website is free or errors or omissions. Nor is there any guarantee whatsoever that service will be 100% uninterrupted or faultless. a)     This site is hosted, controlled and operated from the Republic of South Africa. As Such it is governed by South African legislation, and subject to the disputes clause in these T&Cs.

b)     You and eSbuxStore are subject to the non-exclusive jurisdiction of the South African courts. Each and every section of these T&Cs must be read as individual and separable from the rest of the T&Cs.

c)     Should any court or qualified authority find that any of the terms are invalid or unenforceable; the remainder of the terms and conditions will remain standing, despite invalidity or unenforceability of an individual term.

a)     eSbuxStore may, at its discretion, change these terms and conditions or any part thereof.

b)     As indicated in the T&Cs, it is the responsibility of the user to familiarise yourself with the T&Cs before using the site.

c)     By using the site at all, you recognise that you've read, accepted and agreed to be bound by these T&Cs as amended. Should you not be satisfied with the amendments, you must refrain from using the Site in any way.



Save for urgent or interim relief which may be granted by a competent court, in the event of any dispute of any nature whatsoever arising between you and eSbuxStore on any matter provided for in, or arising out of these T&Cs, and not resolved through the Customer Relations Manager of eSbuxStore, then such a dispute may be submitted to confidential arbitration in terms of the expedited rules of the Arbitration Foundation of South Africa.               i.        For orders of R700 or more(as at this date, but subject to change), eSbuxStore delivers free of charge within South Africa either door-to-door or door-to-post office counter, depending on where you are located.

             ii.        For orders under R700, eSbuxStore charges a non-refundable R120 fee (as at this date, but subject to change) to deliver either door-to-door or door-to-post office counter, depending on where you are located.

            iii.        All deliveries are done through our selected courier services or service providers agreed on in writing prior to ordering.

            iv.        eSbuxStore does not deliver to PO. Box address, unless otherwise.

             v.        Every reasonable effort will be taken to ensure that the delivery costs displayed on the Site are correct at the time of your purchase. However if a delivery fee is incorrectly displayed, eSbuxStore will not be obliged to deliver products at an incorrect delivery fee. eSbuxStore will only be liable to reimburse payment already made by you in the case you choose to cancel the purchase once you have been made aware of the correct delivery fee.

Please note, all delivery options are, at all times, at the discretion of eSbuxStore.


              i.        As the Purchaser, you specify the place of delivery within South Africa and the contact number(s) to be used in connection to the delivery, for each Order when you place such Order.

             ii.        Products will be delivered to the delivery address specified by you during the Order process and if nobody is at the address when the delivery is made, our courier will contact the mobile number you provided to us in the relevant Order and/or a notice of attempted delivery may be put through the letterbox.

            iii.        Our courier will attempt re-delivery one more time thereafter, but if delivery is again unsuccessful, it will be your responsibility to contact the courier company to either arrange that you collect the package from the courier’s nearest depot or to agree upon a new delivery date with the courier.

            iv.        If you have not contacted the courier within a reasonable time, then the package will be sent back to eSbuxStore who will contact you via email to arrange a possible re-delivery at your expense.

Please Note: The purchase must consider the access to the delivery address, availability of an authorised person to accept the order during working hours, public holidays and any foreseeable barriers to delivery before placing their order.



              i.        Unless we inform you otherwise, before you place your order and before the final confirmation, the estimated delivery time for an order in South is between 3- 6 working days.

             ii.         All eSbuxStore deliveries take place during business hours i.e. there are no deliveries over weekends or on public holidays. Please take this into consideration when selecting your delivery address.



              i.        A delivery is considered complete as soon as the parcel is accepted by an individual on your behalf at your specified delivery address, or the parcel is successfully delivered by Speed Services to the post office associated with your delivery address.

             ii.        This also applies when the package has been handed over by the courier, as indicated in the courier's tracking system.

            iii.         It is your responsibility, as buyer, to ensure that you inspect the parcel on arrival and makes known any justifiable complaints. The receiver has the right to refuse the parcel if it appears to have been opened or if it has clearly been damaged.

            iv.        Such complaints and claims must be brought to the attention of eSbuxStore by calling us at 031 337 2112 (Monday to Friday, 08:30 to 16:30 and Saturdays, 08:30 to 13:00).



              i.        If neither the depot nor the tracking system (on the link sent to you by email) provides any indication where the parcel is, you need to call the call centre at 031 337 2112 or send an email to info@esbuxstore.co.za.

             ii.        If the parcel is found, it will be sent to the specified delivery address by the usual procedure, as set out in the delivery clause.




a)     For all In-Store collection orders, a Collection Number will be sent via email, to the email address specified by you at the time of placing the order.

b)     The collection number is an automatically generated number which is known only by you and no one else, including the eSbuxStore staff.

c)     A positive identification document of the collector that is; ID Book/Card, Driver’s Licence or Passport, is required when collecting an order.

d)     No items will be released without presentation of a valid collection number and an acceptable identification document.

Please note: It is a customer’s sole responsibility to safeguard their collection number, AS anyone who presents a valid collection number will be able to collect the ordered items.



Every effort will be made to ensure that eSbuxStore can fulfil your entire order once a purchasing contract (Sale) comes into effect. However, if when packing your order, eSbuxStore is unable to fulfil certain products in your order;

a)     eSbuxStore will notify you thereof by email and tell you when the remaining products will be delivered to you should you still wish delivery to be effected at a later stage.

b)     Should you wish to be refunded for the outstanding product(s), eSbuxStore will reimburse you for the rand value you have paid for such an outstanding product(s), in the same way payment was made.

c)     If eSbuxStore does not notify you thereof via email beforehand, and you only become aware of the fact that the product(s) is /are missing once you receive your parcel, please contact eSbuxStore immediately by calling us on 031 337 2112 or emailing us at info@esbuxstore.co.za to notify eSbuxStore thereof so that we can resolve the situation as quickly as possible. When contacting eSbuxStore via email regarding missing product(s), please use your Order number and the phrase “missing product(s)” in your subject line of your email so that we can best assist you.




Before you return an order, it is very important to contact us first. Please read the details below for more information.


Once a purchase has been processed and delivery effected, no product may be returned to eSbuxStore due to change of mind or for exchange for a different product. We urge our valued Customers to make informed decisions and to be certain when placing the order.



If we accidentally deliver the wrong product to you, with notice, you may return it to eSbuxstore within 7 days of delivery, by following the process set out in section 6 below, and eSbuxStore will make arrangements to replace the product with the correct one.



a)     In the case of a defective, damaged or non-functioning product having been delivered, with notice to us, you may return the product within 7days of delivery by following the process outlined in section 6 below.

b)     eSbuxSore will evaluate each case and may issue a refund, or replace or have the product repaired depending on the unique events and status of the product.



a)     If a product has a supplier’s warranty and such a product turns out to be defective within the warranty period, please notify us as soon as reasonably possible after you become aware of the defect, by emailing us at info@esbuxstore.co.za or calling us on 031 337 2112.

b)     Unfortunately we cannot facilitate returns for products that fall outside of the supplier warranty period.

c)     Please note that any extended supplier warranty is subject to whatever terms and conditions the supplier or manufacturer may impose. These are usually stated in a brochure or leaflet inside or on the product packaging. It is your responsibility to make yourself aware of any such terms and conditions.

d)     It is also important to note that it will be in the supplier or manufacturer’s discretion what remedy they can offer you.

e)     eSbuxStore is under no obligation to provide you with a credit, repair / replacement as your remedy lies with the supplier or manufacturer.


5.     Exclusion

a)     Product which has not been qualified DOA(Dead on Arrival) by eSbuxStore Quality Service department or from the technical centre

b)    faults resulting from normal wear and tear;

c)     damage arising from negligence, user abuse or incorrect usage of the product;

d)    damage arising from a failure to adequately care for the product;

e)     Opened or dismantled Product

f)     Damages, flaws, failures or defects due to external factors

g)    Settings accessible to the user without dismantling the Product, such as image, sound, contrast settings

h)     Improper repairing, modification or maintenance (in ways other than as per the manufacturer guidelines)

i)      Damages due to corrosion, oxidization, poor connection

j)      Damages due to an external power supply problem (except for power supply problems internally related to the device such as a connection to a defective plug).



6.     Return  Condition and Procedure

a)     Conditions

Each Product and its bundled accessories (where applicable) are considered as a single package. As a consequence, if the Customer is unsatisfied with one element of the delivered package, he/she must send it back in its entirety. eSbuxStore reserves the right to send back to the Customer any incomplete package.


b)     Procedure

              i.        Prior to returning a Product, the Customer must inform eSbuxStore by calling or emailing us of his/her intention to do so.

             ii.        The period under which Customer is entitled to contact eSbuxStore department depends on the nature of the return (see relevant sections above).

            iii.        The Customer Service Department will release a single Return Merchandise Authorization (RMA) Form as well as a corresponding RMA form in order to facilitate the return procedure.

            iv.        Once the RMA number is obtained, the Customer must return the Product back to the indicated address via the same shipping method which the parcel was received or any method agreed in writing.

             v.        eSbuxStore recommends Customer to return the Product in such a manner that it may be tracked to ensure its proper reception by eSbuxStore. If this tracking is not in place and the parcel does not arrive at its final destination, the Customer would not be able to open an inquiry with the carrier to locate it.


c)     Packaging instructions for Customers

              i.        Choose a box suitable with the product/s being returned.

             ii.        Ensure the product and/or its contents are adequately packaged.  There must be a sufficient amount of protection around the contents so that they do not touch the inner surfaces or move inside the box.

            iii.        If you return the product with some material that was not bought from eSbuxStore (e.g. you are returning a printer with ink cartridges that were not acquired from eSbuxStore), you must contact our Customer Service and list these items on the invoice of the Product you are returning.

            iv.        NB: Do not write anything on the Product's original packaging or the product itself.

             v.        Attach the paper sent with the RMA number(s) and the delivery address on the cardboard box. Should you have several RMA numbers, you must write each of them on the parcel. Should you need to use several parcels to send the product, you must write the RMA numbers on each box which correspond to the boxes' content.

            vi.        Use the delivery address provided by eSbuxStore

           vii.        Your contact information (such as name, address) must also appear on the parcel.

          viii.        It is very important to write the RMA number(s) on the parcel for a simpler and faster process on receipt.


NB: eSbuxStore will check the Product and its adherence with the reason for return indicated along with the aforementioned requirements. If the returned Product is not compliant with requirements stated above, eSbuxStore will send it back to the Customer at the Customer's expense.

If the reason for return is not legitimate, the return demand may be rejected and Product sent back to the Customer at the Customer's expense, except if Customer informs eSbuxStore by email that he/she changes the reason of the return. In such case, eSbuxStore will receive the return request according to the newly amended reason.

As eSbuxStore is not an appraiser, a defective Product may be sent to the appropriate manufacturer after-sales department and/or service partner as deemed appropriate by eSbuxStore. In this case, the applied procedures will be the ones expressly recommended by the manufacturer and/or the service partner.




1.    eSbuxStore shall take all reasonable steps to protect your personal information. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from http://www.justice.gov.za/legislation/acts/2000-002.pdf


2.    eSbuxStore may electronically collect, store and use the following of your personal information:

a)     name and surname;

b)     birth date;

c)     gender;

d)     country of residence;

e)      closest city;

f)      non-personal browsing habits and click patterns;

g)      e-mail address;

h)      IP address; and

i)       ID number / passport number.


3.    eSbuxStore collects, stores and uses the above mentioned information for the following purposes:

a)     to greet you when making any electronic communication;

b)      to inform you of any changes to these T&C;

c)     to inform you of facts regarding purchases made by you, including relating to delivery of Products;

d)     to inform you of other facts relating to your access and use of the Site;

e)     to inform you about competitions and special offers from eSbuxStore and/or its partners / affiliates

f)      to compile non-personal statistical information about browsing habits, click-patterns and access to the Site;

g)      to verify your identity when transacting with eSbuxStore; and

h)     to ensure that the Products are received by the addressee.

4.    Information detailed above is collected either electronically by using cookies or is provided voluntarily by you. You may determine cookie use independently through your browser settings.


5.    eSbuxStore may collect, maintain, save, compile and share any information collected from you, subject to the following provisions:

a)     eSbuxStore shall not disclose your personal information unless you consent thereto or unless require for the purposes of any legal process.

b)     eSbuxStore  may compile, use and share any information that does not relate to any specific individual; and

c)     eSbuxStore owns and retains all rights to non-personal statistical information collected and compiled by eSbuxStore.


6.    You acknowledge and agree that certain personal information (i.e. your full names, delivery address, email address, and contact number) will be disclosed to the courier company/ies used from time to time to enable delivery of Products purchased, by you.
